At Blue Stripe Structures, we are committed to providing high-quality metal building solutions and professional customer service. Please review the following warranty and refund terms carefully before placing an order.
Manufacturer Warranties
Many products offered through Blue Stripe Structures may include manufacturer-backed warranties covering certain materials, paint systems, or structural components. Warranty coverage, terms, and durations may vary depending on the manufacturer, product type, and installation specifications.
Customers will receive applicable warranty information related to their specific purchase when available.
Blue Stripe Structures does not independently manufacture building materials and therefore does not provide warranties beyond those expressly stated by the manufacturer or agreed upon in writing.
Custom Orders & Deposits
Due to the custom nature of many metal building orders, deposits may be non-refundable once materials have been ordered, production has begun, or scheduling has been confirmed.
Customers are encouraged to carefully review all project specifications, dimensions, colors, certifications, and installation details prior to approval.
Product Specifications and Customer Approval
The customer is solely responsible for reviewing and approving all specifications, dimensions, colors, options, certifications, engineering requirements, and other details prior to production. Once approved, Blue Stripe Structures shall not be responsible for errors, omissions, or changes requested after production has begun.
Cancellation Policy
Orders may not be canceled once materials have been ordered, production has commenced, engineering documents have been prepared, permits have been submitted, or installation scheduling has been confirmed. Approved cancellations may be subject to administrative fees, engineering fees, material costs, restocking fees, and other expenses incurred by Blue Stripe Structures or its suppliers.
Customer Responsibility for Property Damage Risks
The customer acknowledges that installation activities may involve heavy equipment, delivery vehicles, trailers, and construction personnel accessing the property. Blue Stripe Structures shall not be responsible for damage to underground utilities, septic systems, irrigation systems, landscaping, driveways, sidewalks, patios, fencing, grass, vegetation, or other property conditions that are not properly identified, marked, disclosed, or protected by the customer prior to installation.
Engineering, Permits, and Code Compliance
Building codes, zoning requirements, setback requirements, permitting requirements, and homeowner association restrictions vary by location. The customer is responsible for verifying compliance with all applicable local requirements unless otherwise agreed upon in writing. Approval of a building design by Blue Stripe Structures does not constitute a guarantee that the structure will satisfy all local code or permitting requirements.
Acts of God and Force Majeure
Blue Stripe Structures shall not be liable for any delay, failure to perform, increased costs, or inability to fulfill obligations caused by circumstances beyond its reasonable control, including but not limited to severe weather, hurricanes, floods, tornadoes, fire, labor shortages, supply chain disruptions, material shortages, transportation interruptions, government actions, pandemics, utility outages, or other force majeure events.
Third-Party Manufacturers and Installers
Blue Stripe Structures may coordinate services provided by independent manufacturers, contractors, installers, engineers, permitting agencies, lenders, or other third parties. Blue Stripe Structures is not responsible for the acts, omissions, delays, warranties, representations, or performance of independent third-party providers except as expressly agreed in writing.
Color Variation and Material Disclaimer
The customer acknowledges that product images, brochures, renderings, website images, and digital color samples are for illustrative purposes only. Actual colors, finishes, textures, trim, and materials may vary slightly due to manufacturing processes, lighting conditions, monitor settings, and material availability.
Right to Correct Deficiencies
In the event of a claimed defect, installation issue, or warranty concern, Blue Stripe Structures shall be provided a reasonable opportunity to inspect and, if applicable, correct the issue before the customer undertakes repairs, replacement, legal action, or seeks reimbursement from any third party.
Entire Agreement
This Warranty & Refund Policy, together with any signed purchase agreement, quote, invoice, work order, engineering documents, or written addenda, constitutes the entire understanding between the parties concerning warranties, refunds, dispute resolution, and related matters and supersedes all prior verbal discussions, representations, or understandings.
Refund Policy
Refund eligibility is determined on a case-by-case basis depending on the status of the order, manufacturing stage, delivery scheduling, and project circumstances.
Approved refunds, if applicable, may be subject to processing fees, administrative costs, material restocking fees, or other applicable charges.
Completed installations and delivered custom orders are generally non-refundable.
Installation & Site Requirements
Customers are responsible for ensuring proper site preparation, property access, permits, HOA approvals, utility clearances, and any local requirements prior to installation unless otherwise agreed upon in writing.
Delays caused by weather, site conditions, permitting issues, or circumstances outside of our control may affect scheduling timelines.
Limitation of Liability
Blue Stripe Structures shall not be held liable for delays, damages, or losses resulting from circumstances beyond reasonable control, including but not limited to weather events, manufacturer delays, transportation issues, acts of nature, or third-party service interruptions.
By placing an order with Blue Stripe Structures, the customer acknowledges and agrees to the terms outlined in this policy.
Governing Law, Dispute Resolution, Venue, and Attorney's Fees
This Warranty & Refund Policy, and any transaction, agreement, purchase, installation, product, service, warranty, refund request, or business relationship with Blue Stripe Structures, shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
Mandatory Good Faith Resolution
Before initiating any legal action, the customer and Blue Stripe Structures agree to make a good faith effort to resolve any dispute through direct communication. Either party shall provide written notice of the dispute and allow the other party at least thirty (30) days to respond and attempt resolution before pursuing further remedies.
Mediation Requirement
If a dispute cannot be resolved through direct communication, the parties agree to participate in non-binding mediation before filing any lawsuit. Mediation shall take place in Iredell County, North Carolina, and each party shall bear its own costs and expenses associated with mediation unless otherwise agreed in writing.
Exclusive Venue and Jurisdiction
Any dispute, claim, controversy, lawsuit, legal proceeding, or cause of action arising out of or relating to any purchase, agreement, installation, warranty, refund request, product, service, or relationship with Blue Stripe Structures shall be brought exclusively in the state courts located in Iredell County, North Carolina.
The customer expressly consents to the exclusive jurisdiction and venue of the courts located in Iredell County, North Carolina, and waives any objection based upon venue, forum non conveniens, personal jurisdiction, or any similar legal doctrine.
Limitation Period for Claims
To the fullest extent permitted by applicable law, any claim, action, or proceeding arising out of or relating to any purchase, agreement, installation, product, service, warranty, refund request, or transaction with Blue Stripe Structures must be commenced within one (1) year from the date the claim arises or the date the claimant knew or reasonably should have known of the facts giving rise to the claim. Any claim not brought within such period shall be permanently barred.
Attorney's Fees and Costs
In any dispute, legal proceeding, lawsuit, mediation, arbitration, or other action arising out of or relating to any transaction, agreement, product, service, installation, warranty, refund request, or relationship with Blue Stripe Structures, the prevailing party shall be entitled to recover its reasonable attorney's fees, court costs, expert witness fees, collection costs, and other expenses incurred in connection with enforcing its rights or defending against claims.
Waiver of Class Actions
To the fullest extent permitted by law, the customer agrees that any dispute shall be brought solely in the customer's individual capacity and not as a plaintiff or class member in any purported class action, collective action, representative action, or similar proceeding.
Severability
If any provision of this section is determined to be invalid, unenforceable, or prohibited by applicable law, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
By placing an order with Blue Stripe Structures, the customer acknowledges that they have read, understood, and agreed to the terms of this Warranty & Refund Policy, including the dispute resolution, venue, limitation period, and attorney's fees provisions contained herein.
